TERMS CONDITIONS AND WARRANTIES OF SERVICE


  1. DISCLAIMER The words “you” and “your” henceforth refer the person's name entered under billing information. “Us,” “we,” and “our” henceforth refer to “CNet Technologies, LLC (a California Corporation) d.b.a. Best-Teks”. Furthermore, by checking the box agreeing to terms of service during the checkout process, you understand and fully agree to all of the terms, conditions, and warranties all as set forth herein and also agree by checking the box that these herein defined terms, conditions, and warranties become a binding contract between all parties
  2. AUTHORIZATION You hereby authorize any employee, chosen based on our sole discretion, employed by Best-Teks to perform repair & service on your laptop.
  3. RIGHTS We reserve the right to refuse service to anyone for any reason.
  4. DEPOSIT The total amount due during checkout is calculated by taking 10% of the laptop services you choose. This small deposit is necessary to better serve the needs of our customers and to reduce false orders. Remember, this deposit will be applied toward any service that you approve following the FREE DIAGNOSTICS (see below) of your laptop. Please note, if you chose expedited shipping, the full shipping amount will be required.
  5. SHIPPING Fed/Ex or UPS ground shipping is included in the flat rate price of $99.00. You pay for shipping only if you choose to have expedited shipping. Expedited shipping costs includes shipping your laptop to us and shipping it to you following repair. Shipping times may vary by state. For ground shipping times, please click here. Shipping charges may apply only during cancellation (see below) or if you fail to return your laptop to us within fifteen (15) business days following receipt of your box.
  6. FREE DIAGNOSTICS (ESTIMATE) Once we receive your laptop at our repair facility, we will perform a diagnostics on it free of charge. We will run a series of hardware and software tests to determine the cause of problem(s) with your laptop. If your laptop exhibits software-only problems, you will pay only the fixed labor rate of $99.00 and we will proceed with the repair. If hardware is diagnosed as being faulty, we will determine the costs of replacement parts and call you with an estimate prior to proceeding with the repair. In this case you will pay for the flat rate labor of $99.00 plus the cost of replacement parts.
  7. TURNAROUND TIME Turnaround time is determined as follows:
    • 1 - 5 days to ground ship box to you.
    • 1 - 5 days to ground ship laptop to us.
    • 1 - 2 days to repair laptop.
    • 1 - 5 days to ground ship laptop back to you.
    Therefore, total turnaround time is anywhere between 4 - 17 business days depending on your area. Parts availability may also affect turnaround time. The process can be expedited by choosing expedited shipping (see above).
  8. CANCELLATION If, following the free diagnostics (see above), you decline service, your laptop will be promptly returned to you. You agree that your credit card will be charged a total of $29.00 to cover shipping and processing costs.
  9. 30-DAY GUARNATEE (REFUNDS) We believe that your investment should be protected. Through the years we have established a comprehensive system of quality controls to ensure that every laptop that leaves our tech-bench has been checked and rechecked for being 100% operational. It is with this pride in our service that we can stand behind our work and offer our customers a 30-day money back guarantee. We believe this gives our customers ample time to check and operate their machines to ensure that the work that they originally requested is completed to their satisfaction. If, for any reason, you feel that your laptop is not fixed to your satisfaction and we have been given the opportunity to fix it under our 30-day labor warranty (see below), we will gladly reverse the charges and refund the entire invoice amount minus a $29.00 shipping and processing fee.
  10. WARRANTY
    • LABOR: Any software changes/repair made by us based on your original service request is warranted by us for thirty (30) days. If the original software problem recurs within thirty (30) days, we will further fix the problem, free of labor charge, until the problem is completely resolved. However, due the highly variable nature of software, we only cover the software problem that you originally requested us to repair. With this, any software changes or installation performed by you after you take delivery of your machine voids the software warranty. Additionally, the software warranty does not cover any other software problems outside the original software problem that you might discover within the (30) thirty days following service. In the event that you request us to reinstall your operating system, or, if during the course of repair, we determine that reinstallation of the operating system is necessary to fully repair your machine, the software warranty does not cover any previously installed software, settings, Internet, etc. that is not part of the core operating system (see O.S. REINSTALLATION below).
    • VIRUSES/SPYWARE: If viruses and/or spyware were removed by us during the course of repairing your machine, and virus and/or spyware re-infection recurs within the thirty (30) day labor warranty period, additional labor charges will apply to remove the virus/spyware reinfection unless we determine that you have performed anti-virus and anti-spyware updates and have ran a complete spyware/virus scan every two weeks using the anti-virus and anti-spyware software that we installed on your laptop.
    • PARTS: Any new hardware (part) purchased and installed in your machine is warranted by us for ninety (90) days. We will replace the faulty part free of labor charge within the ninety (90) day warranty period. However, many parts carry manufacturer warranties for up to one (1) year. After ninety (90) days, labor and shipping charges (return of the part still covered under its manufacturer’s warranty) apply. Hardware is deemed “faulty” by diagnostics that we perform at our location.
    • WARRANTY SHIPPING: A $29.00 shipping and processing fee will apply for all warranty work.
  11. POST SUPPORT If you have any questions or concerns regarding the service we performed after your repaired laptop has been returned to you, we will first attempt to answer your questions over the phone. This limited phone support is provided free for the duration of the labor warranty (see WARRANTY above). If the duration and/or the frequency of the calls exceed(s) the amount time required to sufficiently address the issue over the phone, based on our discretion, we may require that the laptop be shipped back to our repair facility to further address the problem.
  12. OS REINSTALL If we reinstall your machine’s operating system (Windows 98, ME, 2000, XP, Vista, Mac OS, etc.), whether by your request or by our direction, and you do not request us to retain/reinstall your data/software, we are not to be held liable or responsible for the following loss of data/software: Any files that you may have created (i.e. Word documents, accounting data, tax data, etc.), Internet software, E-Mail software/settings, printers, scanners, any external hardware peripherals (USB, firewire, parallel, serial, etc.), favorites, address books, pictures, music and any other software/data that was installed/created subsequent to the install of the original operating system.
  13. DATA LOSS We are not to be held responsible for any data loss caused by our services. This is chiefly due to the highly variable nature of electronic equipment and computer software.
  14. DATA RECOVERY In the event of hard drive failure, data may be recoverable in certain circumstances. If the hard disk is physically damaged, data recovery may still be possible, but additional charges apply. These charges are variable and are determined by the complexity of the recovery based largely on how many files are requested to be recovered and the severity of the hardware failure. Extensive physical damage to the hard drive can make data recovery virtually impossible and is beyond the scope of our services. However, if the drive is physically intact, successful data recovery is highly likely. We will advise you of any additional charges and recovery likelihood prior to proceeding with data recovery.
  15. OLD PARTS If, as part of the requested computer repair, we replace your old parts with new parts, we will retain your old parts, unless you otherwise verbally request that the old parts be returned to you. You have the opportunity to request this up until you take possession of the laptop. Once you have taken possession of the laptop, paid the invoice in full, and did not request your parts be returned, you agree that the parts are Best-Teks’ to keep indefinitely.
  16. ABANDONMENT If for any reason following the repair of your laptop that the invoice is not paid if full within thirty (30) days, we will send you a letter stating that you have thirty (30) days to pay for the balance in full. If this is not paid thirty (30) days following written notice, your bill will have been past due for sixty (60) days. After sixty (60) days of abandonment, we will remove all new parts, if applicable, and assume ownership of your laptop and, at our discretion, sell the laptop in effort to recuperate labor and part charges.
  17. INDEMNITY You agree to indemnify and hold us harmless with respect to any claims, loss, liability, damage, data loss, production loss due to downtime, or judgment suffered by you, including reasonable attorney’s fees and court costs, which result from any services rendered by us.
  18. ARBITRATION You and CNet Technologies, LLC d.b.a. Best-Teks (“we”) agree to submit any dispute arising under this agreement, except a dispute alleging criminal violations or seeking punitive damages or damages for mental anguish, to arbitration in accordance with the rules of the Better Business Bureau (Binding). A volunteer arbitrator will render a decision based upon fairness, not necessarily upon legal principles, but it will be final and binding on both you and CNet Technologies, LLC d.b.a. Best-Teks (“us”). Judgment on the decision may be entered in any court having jurisdiction. You will not have to pay anything for the arbitration. This Agreement to Arbitrate affects important legal rights. By agreeing to these terms and conditions by checking the box during the checkout process, you and we agree to be committed by the terms of this agreement to arbitrate legal rights. Neither of us will be able to go to Court for disputes once we agree in advance to arbitrate.
